1. Acceptance of Terms
By engaging in a property purchase facilitated by Nelsun Properties, you agree to these Terms of Purchase. If you do not accept these Terms, you may not proceed with a transaction.
2. Property Listings
- Accuracy of Information: We strive to provide accurate and up-to-date property listings. However, Nelsun Properties does not guarantee that all details, including prices, sizes, or availability, are error-free.
- Verification: Buyers are responsible for independently verifying the accuracy of property details, including legal documentation, dimensions, and zoning regulations, before finalizing the purchase.
3. Purchase Process
- Expression of Interest: To begin, you must express interest in a listed property by contacting us or submitting an inquiry.
- Offers and Negotiations: All offers will be communicated to the seller, and negotiations will be facilitated professionally and transparently.
- Agreement: A sale agreement must be signed by both parties outlining the terms, including payment schedules, obligations, and contingencies.
- Ownership Transfer: The transfer of ownership will follow legal procedures, overseen by a licensed legal professional or conveyancer.
4. Payment Terms
- Deposit: Buyers may be required to pay a deposit to secure the property. This deposit is typically non-refundable unless otherwise stated in the sale agreement.
- Full Payment: The remaining balance must be paid according to the agreed schedule. Late payments may incur penalties as outlined in the agreement.
- Third-Party Costs: Buyers are responsible for additional costs, including legal fees, stamp duties, registration fees, and taxes.
5. Legal and Financial Responsibilities
- Legal Compliance: Buyers must comply with all legal requirements and processes for property transactions in Kenya.
- Financing: Buyers are responsible for securing their financing. Nelsun Properties does not offer financial services but may provide recommendations for trusted financial institutions.
- Due Diligence: Buyers are encouraged to conduct due diligence, including title searches, land surveys, and property inspections, before completing the purchase.
6. Cancellations and Refunds
- Cancellations: If a buyer chooses to cancel the purchase after signing the sale agreement, cancellation terms, including penalties, will apply as stated in the agreement.
- Refunds: Deposits and payments are non-refundable unless expressly agreed upon in the sale agreement.
7. Limitation of Liability
- Nelsun Properties serves as a facilitator for property transactions and is not the owner or developer of the properties listed.
- We are not liable for disputes between buyers and sellers or for any financial losses resulting from property defects, legal issues, or unforeseen circumstances.
8. Dispute Resolution
Any disputes arising from the purchase process will be resolved through negotiation, mediation, or, if necessary, arbitration in accordance with Kenyan laws.
9. Changes to Terms of Purchase
We reserve the right to update these Terms periodically. Buyers will be informed of any changes that may affect ongoing transactions.
